These Terms of Service (“Terms”) govern your use of the NytPix mobile application (“App”). By installing or using the App you agree to these Terms. If you do not agree, do not use the App.
“NytPix”, “we”, “our”, or “us” refers to Ethan Weston & Steve Edwards trading as NytPix.app, based in the United Kingdom. Contact: nytpix@outlook.com.
You must be 13 or older to use the App. If you are under 18, you must have a parent or legal guardian’s permission.
NytPix helps you decide what to watch or snack on by saving lists and randomly picking from them. The App may display information from third-party services such as The Movie Database (TMDb). NytPix is not endorsed by or affiliated with TMDb.
The App allows you to create groups on your device and tag movies or snacks to specific members. Groups are stored locally (and optionally in your iCloud account if sync is enabled) and are not shared online. You are responsible for:
You retain all rights to the content you add in the App. We do not access, host, or control your content, as it remains on your device or iCloud. Do not add content that is illegal, abusive, or infringes others’ rights.
NytPix offers optional in-app purchases handled by Apple:
Prices may vary by region and are subject to change at any time. For the most up-to-date pricing, please refer to the App Store listing. All purchases are billed to your Apple ID and subject to Apple’s terms (including receipts, refunds, and family sharing). Purchases can be restored via App Store mechanisms.
Free and paid tiers include ticket/group limits shown in the App. We may enforce technical or anti-abuse measures to keep the App functioning properly.
The App may show information from third parties (e.g., TMDb). Such information is provided “as is” and may be inaccurate or incomplete. Your use of third-party services may be subject to their own terms and policies (for TMDb: Terms of Use).
We may update, add, or remove features at any time. We aim for high reliability but do not guarantee the App will be uninterrupted or error-free. We may suspend or discontinue the App or a feature at any time without liability.
You agree not to:
The App (including software, visuals, and branding) is owned by us or our licensors and protected by law. You may not copy, distribute, or create derivative works except as allowed by these Terms or applicable law.
The App is provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from or related to your use of the App. Our total liability for any claim will not exceed the amount you paid in the 12 months before the claim (if any).
You agree to defend, indemnify, and hold us harmless from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your content, or your breach of these Terms.
You may stop using the App at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the App. Sections that by their nature should survive (e.g., intellectual property, disclaimers, liability limits) will survive termination.
We may update these Terms from time to time. We will post the new version in the App or on our website. Continued use after changes means you accept the updated Terms.
These Terms are governed by the laws of England and Wales (excluding conflict rules). Courts located in England will have exclusive jurisdiction, except where consumer laws in your country provide otherwise.
